M.P. HIGHER JUDICIAL SERVICE (DISTRICT JUDGE - ENTRY LEVEL) DIRECT RECRUITMENT FROM BAR. EXAM-2020

Only Online Applications through Service Provider (www.mphc.gov.in)  are being invited for 47 posts in Madhya Pradesh District Judge (Entry Level) in the pay scale of Rs. 51550-1230-58930-1380- 63070 (Pre revised) in the cadre of Higher Judicial Service by Direct Recruitment from amongst the eligible advocates under Rule 5(1)(c). Recruitment to these posts and conditions of service will be governed by the M.P. Higher Judicial Service (Recruitment and Conditions of Service) Rules, 2017, as amended upto date

Number of Vacancies to the post, Category-wise are as under

Vacancies for the year, 2020  : -  Total Posts : - 14 Post

Carry forward Posts from year 2019 ( backlog) : -  Total Posts : - 33 Post

Total Vacancies  : -  47 posts

Note:-

Out of total 47 (Forty Seven) aforesaid vacancies, 2% posts are reserved for Physically Handicapped (Specially abled) candidates, which shall be free from the reservation roster. It is made clear that no grace marks or concession marks shall be given to such  candidates, he / she has to secure minimum marks at each stage provided for respective category.

It is made clear that all candidates who are not bonaflde domicile of State of Madhya Pradesh shall be treated as Unreserved category irrespective of their categories in their own States and they are required to flll up their category as Unreserved (UR) in the application forms and wherever required during Process of Examination and Selection.

If such reserved posts or any of them are not filled in a given recruitment year due to non-availability of suitable candidates, they shall be re-advertised for respective categories once more. If any such posts remain vacant due to the same reason, they shall be treated as un-reserved posts.

The number of aforesaid vacancies are likely to be varied, depending upon the requirement of the High Court and exigency of the situation as and when necessary.

Hon'ble the Supreme Court vide order dated 10.05.2019 passed in SLP No. SLP No.14156/2,015 (Dheeraj Mor Vs. The High Court Of Delhi) has been pleased to direct that "no ne-w appointments be made from now onwards of in-service candidates against quota reserved for Bar."

Selection process is subject to decision of Hon'ble the Apex Court / High Court and decision may affect selection under under Rule 5(1) (c) of M.P. Higher Judicial Service (Recruitment and Conditions of Service) Rules, 2017.

2. Eligibility/Oualifications ; 

No person shall be eligible for appointment to the post of District Judge (Entry Level) in Higher Judicial Service by direct recruitment from Bar unless:-

(a) He/she is citizen of India;

(b) He/she has attained the age of 35 years and has not attained the age of 45 years, as on lst January, 2020

(c) (i) He/she has practiced as an Advocate for not less than seven years on continuous basis as on 1 St January, 2020 (certificate of competent authority is required).

(ii) Prosecution Officers/Addl./Assistant Prosecution Officer will be treated to be an Advocate and eligible as per judgment of Hon'ble Supreme Court in Civil Appeal No. 561/2013 Deepak Aggarwal ys. Keshav Kaushik & Others.

(d) He/she has good character and is of sound health and free from any bodily defects, which render him, unfit for such appointment.

The aforesaid fact of practice may be prz."c} /czcz.e seen by one or more of the following modes:-

(1) By Income-tax return of candidate (at least three previous years) in which her/his income should be shown from the profession of an advocacy being an advocate. (Detail has to be furnished by the candidate.)

(2) The candidate shall also has to give detail/list of at least 10 cases and detail of court concerned Courts / Tribunal in which the candidate is claimed appearance being an advocate, together with the self attested copy of the Judgments / Final orders

Note : - 

Candidates interested in and who are eligible for being considered for the post, should submit their applications as per the Online Application-format available on www.mphc.gov.in by filling in all details relating to the all certificates/testimonials relating to their date of birth, caste, category, qualifications, domicile, experience, standing at the Bar efc

3. Disqualifications :-

In any of the following cases. Applicants/Candidates may be liable for Prosecution and/or cancellation of their candidature for selection may be canceled and he/she may be Prohibited. temporarily or for any specific time Period. to appear in any Exam-nation conducted by M.P. High Court :-

(a) has more than one spouse living ;

(b) has been dismissed or removed from service by any High Court, Central or State Government, Statutory Body or Local Authority ;

(c) has been convicted of an offence involving moral turpitude or has been permanently debarred or disqualified by any High Court or Union Public Service Commission or any State Public Service Commission or any Services Selection Board or Staff Selection Commission constituted under statutory provisions by the Government ;

(d) has been involved in such other criminal case which in the opinion of the Appointing Authority is not suitable to discharge the functions as Judicial Officer ;

(e) has been found guilty of professional misconduct under the provisions of the Advocates Act,1961 or any other law for the time being in force ;

(f) has more than two living children on of whom is born on or after 26-01-2001 in terms of sub-rule (6) of Rule 6 of The Madhya Pradesh Civil Services (General Conditions of services) Rules,1961 ;

Explanation :-

For the purpose of this Sub Rule, child born within 280 days from the date of 26/01/2001 shall not constitute disqualification

(g) if he has accepted or accepts dowry at the time of his marriage

Explanation :-

In this clause, the word ``dowry" shall have the same meaning as assigned to it in Dowry Prohibition Act, 1961 (No. 26 of 1961).

(h) if he or she does not fulfill the provisions of M.P. Higher Judicial Service (Recruitment & Conditions of Service) Rules, 2017 and M.P. Civil Services (General Conditions of Service) Rules 1961 and any other Rules/Order(s) prescribed for Cadre of Higher Judicial Service.

Note : - 

Permission to appear in the exam is provisional and if at any stage, it is found that the candidate does not fulfill the conditions of advertisement or certificates are found false then histher candidature shall be rejected without assigning any reason.

(i) If he /she takes or attempts to take any favour in any form at any stage of Examination, or,

j) Impersonation by or for the candidate/applicant, or,

(k) Making or submitting any forged document in support of his or her candidature, or,

(I) If he/she conceals any material information or provides any false information, at any stage of selection process or appointment, or,

(m) If he/she uses or attempts to use, improper or illegal means, either for purpose of being permitted to appear in examination or at any stage of Examination in Examination Room/Hall, or,

(n) If he/she, during Examination or Interview, harasses or threatens or causes physically injury to or misbehaves with, any Officer or employee or person engaged there for, or,

(o) If he/she, disobeys any directions relating to Examination including oral directions by the Invigilator or Observer or any other Officer or Employee engaged in conduction of Examination.

(p) If he/she uses or attempts to use unfair means or brings any prohibited item within the campus or in examination room/hall of online preliminary exam or Main exam or Interview, or causes any harm to the computer or any wire, peripherals attached thereto or to any furniture, buildings or any other thing of any Examination Centre, or talks with any candidate or other person or peeps on the computer-screen, table or answer-sheets of other candidates, during Examination.

(q) Mobile Phones, pagers or any electronic & communication devices/ calculators are banned & not allowed inside the main gate of premises where the examination, either online preliminary or main written Exam shall be conducted. Any infringement of these instructions shall entail action of cancellation of the candidature and expelling of the candidates from Examination including ban from future examinations.

(r) In all or any of aforesaid case, in addition to the cancellation of candidature /selection/appointment, the candidate may be prosecuted for an offence punishable under M.P. Recognized Examination Act, for which the punishment is up to 3 years of Imprisonment or/and under other relevant Law

(s) Candidates are advised not to bring any banned items and any valuable/costly items to the examination centre, as there may not be any arrangement for safe-keeping for the same. High Court or Service Provider or Examination Center will not be responsible for any loss in this regard.

(t) Canvassing in any form, at any stage of process, will also be a disqualification. Similarly, any attempt on the part of a candidate to enlist support for his candidature/selection/ appointment through persons of influence or officers of Government will also disqualify him for candidature/selection/appointment.
